JUDICIAL MANDATORY SETTLEMENT CONFERENCE PROGRAM

    The Judicial Mandatory Settlement Conference (MSC) Program is free of charge and staffed by experienced sitting civil judges who devote their time exclusively to presiding over MSCs. The program is available in general jurisdiction cases from independent calendar (IC) and complex courtrooms.

    Scheduling the MSC

    1. The IC or complex judge must order the parties to the MSC program.
    2. Parties must agree on three preferred MSC dates and may request two preferred MSC judges and note them on the intake form.
    3. Email the completed Settlement Conference Intake Form (Revised March 2019) to SSCMSC@lacourt.org.
    4. Parties will receive an email with the MSC date, assigned MSC judge and instructions for attending the MSC. A minute order will also be issued by the IC/Complex courtroom.
    Remote/Virtual MSC

    Remote MSCs are available via an online video conference platform. The court will send an email to the emails listed on the intake form with instructions on the remote MSC.

    Time allocated for MSC

    Each MSC is allocated a maximum of three hours. If the MSC is expected to take longer than three hours due to complexity of the case and/or number of parties, the intake form should contain a request for a longer time slot and the basis for this request.

    Required documents
    Five court days prior to the MSC, parties must email, in the same email, to the assigned MSC judge’s staff these two documents:

    1. Stipulation to Policies and Procedures for Judicial Mandatory Settlement Conference, signed by all counsel and MSC participants; and
    2. Settlement conference statement. Maximum five pages. See, L.A. Superior Court, Rule 3.25(e); CRC, Rule 3.1380(c). Settlement conference statements are limited to five pages each, exclusive of exhibits.  Limit your exhibits to 10 pages. You may share additional exhibits at the MSC, if necessary. The statement must be served on opposing counsel 5 court days prior to the MSC.
    3. Confidential MSC statements: MSC statements are not a public record since they are not filed in the official court record (eCourt). They are emailed to the staff for the MSC judge and served on opposing counsel. They are destroyed after the MSC. If a party wants to share confidential information with the MSC judge and not with opposing counsel, the party must prepare two statements, a confidential statement marked “CONFIDENTIAL” and a non-confidential one. Both statements must be emailed to the staff for the MSC judge at the same time (5 court days prior to the MSC) and opposing counsel must be served with the non-confidential statement. The confidential statement must clearly specify what information is confidential by either bolding the confidential text or other means. Do not use color font to designate confidential text.

    Requests to continue or take MSC off calendar

    A request to continue the MSC must be made as soon as counsel is aware of a potential conflict. The request must be made by written stipulation of the parties and emailed to the assigned MSC judge’s staff. The stipulation must include three new dates preferred by all parties.

    A request to take the MSC off calendar must be emailed by ALL counsel to the MSC judge’s staff and specify the reason for the request, such as case settled prior to MSC, stay was imposed due to bankruptcy, corporation is suspended, etc.



    Language interpreter

    Only certified/registered interpreters may interpret in court proceedings. If a party needs an interpreter, one must be requested no later than five court days in advance of the MSC by emailing the MSC Judge’s staff. The request must include the case name and number, MSC date and time, MSC judge and the language.

    Frequently asked questions

    1. Can counsel sign the Stipulation to policies and procedures on behalf of the client. NO.
    2. If a different attorney from the same firm appears at MSC than the one who signed the stipulation, does that new attorney have to also sign the stipulation? YES
    3. Can counsel or another person interpret for the client. NO. Court interpreters must be certified or registered with the Judicial Council of California.
    4. Do I have to serve my separate confidential brief on opposing counsel? NO, but you must serve the non-confidential MSC brief on opposing counsel and email the confidential and non-confidential MSC brief to the staff of the MSC judge.
    5. On virtual MSCs, can a party not be placed on a video platform where they can see the other party? Submit your request to the MSC judge’s staff prior to the MSC.
    6. Do all participants, including clients, have to wear “court attire” to appear virtually at the MSC. YES. See LASC, Local Rule 3.43.
    7. Can my client have a “support person” at the virtual MSC? Submit request to MSC judge prior to the MSC.
    8. Do I have to attach both documents (MSC statement and Stipulation) to the same email to MSC staff? YES. Attach both documents to the same email, otherwise they will not be accepted.
